Customer Terms

Last updated: 14 October 2026

These terms apply to you when a vehicle dealership sends you a link to complete the paperwork for a vehicle through Free the Desk.

They cover our relationship with you — the platform you are using. They are not the contract for the vehicle. That contract is between you and the dealership, and you will read and sign it separately.

1. What Free the Desk is, and what it is not

Free the Desk provides the software the dealership uses to prepare, present, sign and store the paperwork for your purchase, and to lodge your vehicle licensing application with the Department of Transport on your behalf if you authorise that.

We are not a party to your purchase. We do not sell you the vehicle, we do not take your money, and we do not decide anything about your transaction. The dealership does all of that.

We do not give legal advice. The documents you are shown are prescribed forms and standard terms selected by rules, not by judgment about your situation. If you want advice about what any of them means for you, get it from a lawyer.

2. Your dealership sees what you give us

Everything you enter and upload here is given to us for the dealership named in your sale, and the dealership can see it. That includes:

The dealership needs all of it to complete the sale and to license the vehicle in your name. If you are not willing for the dealership to see it, do not enter it here — speak to them directly instead.

The dealership's own handling of your information is theirs, not ours. Our handling is set out in our Privacy Policy.

3. Signing electronically

By using this service you agree to sign documents electronically and to receive them electronically, for the purposes of the Electronic Transactions Act 2011 (WA).

When you sign a document here, you type your full name and confirm a declaration that we show you in full. We then create the final PDF, record the exact wording you agreed to, the time, the internet address you signed from, and a cryptographic fingerprint of the exact document. That record is what makes your signature provable. It is an electronic-signature record; it is not a digital certificate and we do not describe it as one.

Signing the vehicle sale contract is an offer to buy, not a purchase. Under the Motor Vehicle Dealers (Sales) Regulations 1974 (WA) Schedule 5, a contract exists only once the dealership has also signed it and told you they accept. We will email you when that happens. Until then you may withdraw, and the offer lapses by itself at the close of business on the next normal business day for motor vehicle dealers.

4. Identity verification

Before a vehicle is licensed in your name, the dealership has to satisfy itself that you are the person being licensed. You will be asked to upload a photograph of the front and back of your driver's licence, and a photograph of your face.

Those images are stored outside any publicly reachable location and are visible only to the dealership handling your sale and to Free the Desk staff where they are needed to run or support the service.

They are kept rather than deleted after a set time. They are the dealership's record that it checked who it was licensing a vehicle to, and that record has to last as long as the questions about the sale can be asked. How long that is is set by the Motor Vehicle Dealers Act 1973 (WA); section 9 of the privacy policy sets out what we keep and why.

A member of staff at the dealership reviews them. If one of them cannot be read, you will be asked for that one again — not for all of them — and you will be told why in plain words.

5. Your details have to be right

The details you enter print onto a licensing application and onto a statutory declaration. Giving false or misleading information on those carries real penalties, which is why we ask you to check them rather than asking us to check them for you.

You can change them for as long as you still have something to do on your sale. Once you have finished your part, changing anything is a conversation with the dealership — which they can still act on.

If you change a detail after signing something, the signature no longer matches the document and you will be asked to sign it again. That is deliberate. It stops the wrong name being sent to the Department of Transport.

6. Payment

Any money you pay for the vehicle goes to the dealership, by bank transfer to the account details they give you. Free the Desk never receives, holds or handles your money, and we cannot see whether a transfer has arrived.

When you tell us you have paid, that is a claim we pass to the dealership to check against their own bank. The dealership confirms receipt, and only then does the licensing step continue. A screenshot or a receipt you upload is kept with the sale, but it does not move anything on its own — it proves a file arrived, not that money did.

7. Access to your sale

Your link is a credential. Anyone who opens it can see your sale and act on it, so treat it the way you would treat a password. Opening it on your own device exchanges it for a browser cookie limited to that one sale, after which the link in your email stops being a live credential.

The reference and password in the same email let you get back in on another device. If you lose them, the dealership can send a new set.

Your access ends if the dealership cancels the sale. It does not end when the sale completes — your signed documents stay available to you.

8. Availability and liability

We provide the service with reasonable care and skill. We do not promise it will be uninterrupted or error free.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where our liability can be limited, it is limited to resupplying the service or paying the cost of having it resupplied.

Your rights about the vehicle — including the statutory warranty, if it applies to your vehicle — are against the dealership under the Motor Vehicle Dealers Act 1973 (WA) and the Australian Consumer Law. They are unaffected by these terms.

9. What you must not do

Do not use this service to submit information that is not yours to submit, to impersonate anybody, or to attempt to reach a sale that is not yours.

10. Changes

We may update these terms. The version that applies to your sale is the version shown to you at the time you accept it, and we keep a dated copy of it.

11. Contact

Questions about your vehicle, your price, your delivery or your contract are for the dealership named on your sale, not for us.
